Terms of Service

These Terms govern your access to and use of Noran Shine CRM (the “Service”), operated by Noran Shine Photography LLC (“we,” “us,” “our”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & accounts
You must be 18 or older and provide accurate information. You are responsible for safeguarding your credentials and for all activity and users under your account.
2. The Service
A CRM that, where connected, receives and sends Instagram and Facebook direct messages, captures leads, and runs workflows, with additional integrations (Stripe; in the future, Google Business, scheduling, and insights) over time. We may modify features.
3. Connected accounts & third-party services
You authorize us to access connected-account data only as needed for the features you enabled and only to the extent of the permissions granted. Your use of each connected service remains subject to that provider's terms (including the Meta Platform Terms and Meta's user policies). You may disconnect at any time.
4. Your responsibilities & your clients' consent
You represent that you have all necessary rights, consents, and legal bases to collect, store, and message the contacts you put in the Service (including consent to DM, SMS, and email). You will comply with anti-spam, telemarketing, and messaging laws (e.g., TCPA, CAN-SPAM) and Meta's messaging policies. As between us, you are the controller of your clients' data and responsible for their requests.
5. Acceptable use
No unlawful or abusive use; no spam, harassment, or deception; no malware or attempts to breach security (including tenant isolation); no scraping or accessing other customers' data; no violating connected-service terms; and no reselling the Service except as permitted.
6. Fees
The Service is currently provided without charge.
7. Intellectual property
We own the Service and related intellectual property; you receive a limited, non-exclusive, non-transferable right to use it. You retain rights to your Customer Data and grant us a limited right to process it to provide and secure the Service.
8. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties. We do not warrant uninterrupted or error-free operation, or the availability or accuracy of third-party (including Meta) data.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability is capped at the greater of the amounts you paid in the prior 12 months or USD 100.
10. Indemnification
You will indemnify us against claims arising from your use of the Service, your Customer Data, your messaging, or your breach of these Terms or any provider's terms.
11. Termination
You may stop using the Service and delete your account at any time; we may suspend or terminate your access for breach or if required by law or a provider. Deletion is handled per the Privacy Policy and the Data Deletion page.
12. Governing law
These Terms are governed by the laws of the State of Florida, USA, with exclusive jurisdiction of the courts in Hillsborough, Florida.
13. Changes
We may update these Terms; we will revise the “Last updated” date above when we do.
